1. Our offering

We connect you with locals to experience exciting things all over the world.

GrabAtour is a Price Comparison network for Local Experiences. We are a marketplace where demand (travelers) meets supply (local hosts). Through our website, travelers can book foodie experiences, tours and activities with local hosts from many different service providers all over the world.

Our Service is a search engine for tours and activities. GrabAtour does not provide, own or control any of the services and products available for access through Our Service, such as tours, local experiences, or other activities (the “Tours and Activities”). The Tours and Activities are owned, controlled or made available by third parties (the “Experience Providers”) either directly (e.g. tour guide) or as an agent (e.g. online travel agency). The Experience Providers are responsible for the Tours and Activities. The Experience Provider’s terms and privacy policies apply to your booking so you must agree to, and understand those terms. Further, the terms of the actual experience provider (e.g. tour operator) apply to your travel, so you must also agree to and understand those terms. Your interaction with any Experience provider accessed through Our Service is at your own risk and GrabAtour does not have any responsibility should anything go wrong with your booking or during your travel.

GrabAtour is a private company having its offices in Auckland, New Zealand.

3. Applicability of T&C’s

When you visit our website and/or use our services you agree with these T&C’s.

You must read these T&C’s before using our website and/or services. Use of our website and/or services, regardless of whether you are a website visitor, a traveler or a host, constitutes an agreement to all terms and conditions in these T&C’s and you warrant that you understand, agree to and accept all terms and conditions contained here.

4. Privacy policy

We respect your privacy.

We respect your privacy and are committed to protect the information you share with us. We believe that you have a right to know our practices regarding the information we collect when you visit our website or use our services. 5. Booking via GrabAtour

If you make a booking through Our Service for Tours and Activities, that booking is made with the Experience Provider named on the booking page and Our Service only acts as a user interface. Accordingly, GrabAtour has no responsibility for the booking or the Tours and Activities because GrabAtour has no involvement in creating the description of the Travel Product, in defining the price and any fees, and in providing the Tours and Activities that you book. If you have any issues or disputes around your booking and/or the Travel Product, you agree to address and resolve these with the Experience Provider and not with GrabAtour.

6. Intellectual Property

We, along with our corporate affiliates, the Experience Providers and other licensors own all of the text, images, software, trademarks, service marks or other material contained on Our Service. You will not copy or transmit any of the material except for your personal, non-commercial use. All copyright, trademark and other proprietary rights notices presented on Our Service must appear on all copies you print. Other non-GrabAtour product, service, or company designations on Our Service belong to those respective third parties and may be mentioned in Our Service for identification purposes only. You should contact the appropriate third party for more complete information regarding such designations and their registration status. Your use of and access to Our Service does not grant you any license or right to use any of the marks included on Our Service.

7. Use of Our Service

You may only use and register to become a user of Our if you are of sufficient legal age and can enter into binding contracts. If you become a registered you are responsible for maintaining the secrecy of your passwords, login and account information. You will be responsible for all use of Our Service by you, anyone using your password and login information (with or without your permission) and anyone whom you allow to access your travel itineraries. All information that you provide to us must be accurate and up-to-date. If any of your information changes, you must immediately update it. If you have reason to believe that your account is no longer secure (e.g., loss, theft or unauthorized disclosure or use of your information or computer or mobile device used to access Our Service), you must promptly change your Personal information that is affected.

If you decide to receive messages or other communications from Our Service directly to your mobile device, you are solely responsible for keeping us updated with your current phone number, respectively updating to the latest version of the mobile app, and for any charges incurred to receive such messages. We will not be liable for information sent to a device that is associated with your outdated mobile phone number or using an outdated mobile app. If you install any software or enable any service that stores information from Our Service on any mobile device or computer, it is your responsibility, prior to transfer or disposal of such device, to remove your information or otherwise disable access to such software or service, in order to prevent unauthorized access to your information or account.

You may only use Our Service to search for legitimate travel deals and you may not use Our Service to make any false, fraudulent or speculative reservation or any reservation in anticipation of demand. By using Our Service you agree to comply with laws that apply to the United States and your own country, including laws that apply to exporting technical data.

In addition, you agree not to do any of the following without prior express written permission of GrabAtour:

access the site with any manual or automated process for any purpose other than your personal use or for inclusion of GrabAtour pages in a search index. Use of any automated system or software to extract data from Our Service (“screen scraping”), for commercial or non-commercial purposes, is prohibited;
violate the restrictions in any robot exclusion headers on Our Service or bypass or circumvent other measures employed to prevent or limit access to Our Service;
deep-link to any portion of Our Service for any purpose;
use any device, software or routine that interferes or attempts to interfere with the normal operation of Our Service or take any action that imposes an unreasonable load on our computer or network equipment;
reproduce, duplicate, copy, sell, trade, resell or exploit Our Service;
use any feature of Our Service for any purpose that is unlawful, harmful, or otherwise objectionable or inappropriate as determined by us;
post or distribute any material on Our Service that violates the rights of any third party or applicable law;

8. Proprietary Material

All text, graphics, editorial content, data, formatting, graphs, designs, HTML, look and feel, photographs, music, sounds, images, software, videos, designs, typefaces and other content (collectively “Proprietary Material”) that you see or read on this website is owned by us, or is used with the owner’s permission. This Proprietary Material is protected in all forms, media and technologies. You may not copy, download, use redesign, reconfigure, or retransmit anything from this website without our prior written permission.

9. Quality of information

While we do our utmost best to verify the quality of the events hosted by our hosts, we cannot guarantee these are flawless and neither can we guarantee that all content on our website is without errors.

In the event of misleading representation or misconduct on our website or in the framework of the events held by hosts through our website and/or services, we may decide, in our sole discretion, to credit the traveler with a refund for the reservation amount paid or part thereof and charge the host with this amount. No action of us may be construed as accepting any liability other than as mentioned herein.

Therefore, use your own best judgment when using any of the services provided by our hosts.

Notwithstanding the foregoing, we, including without limitation any content, data and any information related hereto, is provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, express or implied, including but not limited to warranties of title or non-infringement or implied warranties of use, merchantability or fitness for a particular purpose or use.

10. Warranties

We don’t give any warranties.

We do not warrant that our website and/or our services will be uninterrupted or error-free. We may correct, modify, amend, enhance, improve and make any other changes to our website and our services at any time or discontinue displaying or providing any content or features without a notice to you, being a website visitor, a traveler or a host.

11. Disclaimer

We do our very best to make sure all the information we provide you is 100% correct. However, as we are human beings too, errors are made.

We hereby disclaim all warranties and conditions with regard to the use of our website and/or services, including, but not limited to, the availability, reliability, or quality of our website and services, the events distributed through us, including the nature and quality of the events, and is not and shall not be responsible for any error, fault or mistake of any and all content and information received through our us, including by hosts or travelers. We do not endorse any entity, product or service mentioned in any user generated content available on our website.

12. Liability

GrabAtour’ responsibility is limited to facilitating the availability of our website, application and services. The participation in any of the events hosted by the hosts is at your own risk. GrabAtour’ liability for damages shall be limited to the amount paid to us by you as a traveler. Except as provided herein, in no event shall we be liable for any indirect, special, incidental or consequential damages of any kind, whether in an action of contract, negligence or other tortious actions resulting from or arising out of participation in any of the events hosted by the hosts.

13. Issues and Complaints

We’ll assist you in case of issues or complaints where possible.

In case of a complaint about, or issue with the platform, app or services, please contact GrabAtour at contact@grabatour.net or 0061426465450 to resolve the problem. In case of a complaint about an event you agree to contact GrabAtour within 1 day after the complaint has arisen and you agree to cooperate with and assist GrabAtour in good faith and you agree to provide GrabAtour with such information and take such actions as may be reasonably requested by GrabAtour. As a host you agree that in case of a no show or dis-satisfactory deviations in the event caused by you, the guest will be refunded and you won’t receive payment. As a guest you understand that in case of a no show or no completion of/interruptions during the event caused by you, you as a guest are responsible for any damages up to the amount paid.

In case of any damage claims or other complaints related to the event exceeding the amount paid, GrabAtour will mediate in finding a reasonable solution between guest and host.
